The Rise of Corporate Rights and Its Meaning for Democracy

Doug Kendall, founder and President of the Constitutional Accountability Center, discussed the implications of recognizing corporate personhood in new contexts that are not faithful to the original meaning and intent of the Constitution. Discussing the results of recent analyses done by CAC and others, Mr. Kendall argued that the expansion of corporate rights has become a hallmark of the Roberts Court, to the detriment of the American people. The ensuing discussion, moderated by Chimene Keitner of UC Hastings, covered issues ranging from the role and influence of unions, to the strategic value of originalist approaches to constitutional interpretation, to the relationship between the Supreme Court’s Citizens United opinion and corporate liability for human rights abuses.
